This data protection declaration applies to all persons who use the services of

to use. We thereby inform you about the type, scope and purpose of the collection and use of your personal data by our company. We respect your privacy and strive to strictly comply with the legal requirements for the processing of your personal data (EU Regulation No. 679/2016 (GDPR), DSG and TKG 2003). All your personal data will be processed on this basis.

The person responsible for data processing is Messmer Hotel am Kornmarkt GesmbH & Co. KG (office@hotel-messmer.at).

Information obligations (Articles 13 and 14 GDPR)
Your personal data, that is

  • Your master data (last name, first name, address, email address, telephone and fax number, date of birth, customer number) as well as language and vehicle license plate number,
  • the data in travel documents presented (passport number, passport details, date of birth, issuing authority, term, nationality) and ID cards (identity card, driving license, etc. including issuing authority and term),
  • the data on the payment method and in connection with payments, in particular with EC cards, credit cards and bank cards, 
  • the length of stay you have requested as well as the destinations, hotels, contact persons, conditions, special services, health data, frequent flyer number, personal preferences that you disclose to us, and 
  • special categories of data such as health data, special needs data and marriage/partnership data

are required for our services. This also includes bookings for travel, tour guides, catering, rental vehicles, transfers, registration processing, insurance, events, tours, accreditations, vouchers including customer creation, billing and their verification (B2B, B2C, FIT), ticket bookings.

We therefore store and process this data for these purposes and, if necessary, pass it on to third parties with whom we work together to provide the most effective and best possible service for our customers - this can also include service providers in third countries as processors, software and agency service providers belong –, transmitted.

The legal bases for these data processing processes are

  • the fulfillment of our pre-contractual and contractual obligations towards you, 
  • your consents, 
  • Statutory, contractual or other legal obligations on our part (e.g. documentation rights and obligations under accounting, tax and customs law, contracts, reporting, legal disputes)
  • § 96 TKG and
  • our legitimate interests (e.g. improving our customer service, including in the area of ​​direct advertising or protecting our own legal interests).

The duration of storage is determined by the duration of our business relationship, the consent you have given, and the statutory retention requirements and legal obligations that apply to us. We emphasize that in the case of regular cooperation to provide the best possible customer service, we strive to know the customer requests you have already communicated to us so well that we can satisfy you on an ongoing and long-term basis.

Our websites
When you access our website, your access data is automatically collected and stored. This access data may include, in particular, the page accessed, the files viewed, the date and time of the access, the user's IP address, data of the accessing computer, in particular the browser and the operating system, as well as the amount of data and the report of the successful access. We use this access data for internal statistical purposes to ensure the security of our offer and to optimize the offer. If an illegal act is suspected, the access data will be evaluated to preserve evidence.

By entering your personal data into one of our contact forms, you agree to the transmission to, storage and processing by us for the duration of the processing of this specific request. This applies in particular to your inquiries via contact form, chat and emails that you send to us. We need this data to process your request and in these cases we also store your IP address for the purposes of preserving evidence. The data will be stored for as long as this is necessary to deal with any additional or subsequently asked questions by you or us.

Newsletter
You are free to subscribe to our newsletter. The registration, for which you must provide your e-mail address and give your consent to receive the newsletter, can only become effective if you confirm a registration link that you receive by e-mail. In order to be able to provide you with targeted information in the newsletter that is of particular interest to you, we allow you to provide information about specific interests, deadlines, locations and regions and the like when you register.

Transfer to third parties / obligation of processors
We may use your personal data

  • to processors (e.g. for our electronic advertising in the form of newsletters) as well as to third parties who must be involved in order to provide the services you request, all of whom have committed themselves to complying with the applicable data protection standards, 

may also be transmitted outside the EU. If compliance with European data protection standards is not possible - for example because standard contractual clauses, adequacy decisions or certifications are not guaranteed in the specific case - we will inform you in good time and also obtain the necessary consent from you. Cookies and tracking services
We use cookies, which are small text elements used to store information in web browsers. Cookies are recognized the next time you visit our website and contribute significantly to speeding up loading processes and making the use of our offers convenient for you. The information recognized and stored by cookies is used for your recognition, but also for the analysis of your user behavior. Recaptcha protects our website from mass contact from automated programs (“spambot attacks”). This service is technically necessary for the secure operation of the website. When you visit a page with embedded Recaptcha, a direct connection is established with Google's servers. Information about the use of this website and other data, such as your IP address, may be transmitted to Google. We use Google Analytics, a web analysis service provided by Google Ireland Limited, 4 Barrow St, D04 E5W5 Dublin, Ireland (“Google”). Google Analytics uses cookies. The information generated by the cookie about your user behavior is usually transmitted to a Google server in the USA and stored there. Your IP address will be shortened beforehand within the European Union and thus anonymized or at least pseudonymized. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.
Google uses this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not combined with other Google data. Rights of those affected / objection / contact
You can request information about your personal data stored by us at any time, free of charge. As a data subject, you also have the right to object, information, deletion, correction, restriction and transfer of your personal data. Since we process the data based on our legitimate interests, you generally have the right to object if you have reasons arising from your particular situation that speak against this processing. Since we (also) process the data for direct advertising, you can object to this processing for direct advertising purposes at any time.

You can revoke any data protection consent you have given us at any time. The revocation does not affect the lawfulness of the processing that has taken place up to that point. A revocation means that we will no longer process your data for the purposes mentioned above from this point onwards.
